Bacularis.com is a web service whose main goal is to help Bacularis users. We (Bacularis.com people) are here to support you in creating, maintaining and managing your Bacula environment through the web interface.
These Terms of Service ("Terms") describe our commitments to you, and your rights and responsibilities when using our services. Please read them carefully and contact us if you have any questions for that. If you don’t agree to these Terms of Service, don’t use our services.
These Terms govern your access to and use the software and services through: Bacularis.com ("Website"), Users.Bacularis.com ("User Panel"), Packages.Bacularis.com ("Subscription Repositories") and Packages.Bacularis.App ("Free Repositories").
All Bacularis.com services are owned by Baculus Marcin Haba company.
The Terms becomes binding and effective for any use of our services on the date ("Effective Date") that the user clicks on the designated "Join now" button on a registration web form in the User Panel.
Using our services requires having the User Panel account. The account can be created by registering in the User Panel.
You agree to provide accurate and actual contact information in the registration process. We can use the information to communicate with you in important announcements like changes in these Terms or Privacy Policy, information about planned maintenance works on the Bacularis.com servers and other important messages. The contact information are not used to send any marketing materials.
We may restrict your access to User Panel until we are able to verify your contact information like email address.
The User Panel account is individual and cannot be shared with others. Specially you are responsible to not share the credentials for: the User Panel, the Free Repositories and Subscription Repositories. Please inform us immediately about any unauthorized uses of your User Panel account or about any other breach of security. We may deactivate your account if we detect that your account access has been compromised.
The binary package repositories are accessible for users registered in the User Panel.
When you create an account in the User Panel, we create access to the Free Repositories in your account. You may use this access to install and update the software binary packages. For each repository we provide you the repository installation instruction.
The repository access is continuous with exceptions short moments of unavailability in case performing maintenance works. We will inform you in advance by e-mail about these planned works.
Both for using the Free Repositories and Subscription Repositories you agree to comply with the designated repository limits. The maximum number of hosts limit refers to using repository access both to phisical hosts (bare-metal servers) and virtual hosts (virtual machines, containers). Information about applicable limits for repositories you can find on the Website or in the offer in the User Panel.
In the User Panel you may contact our Support Team to solve your problems with Bacularis. The support service is paid per incident and it is available in a credit-based model. One incident costs one credit. If you have more problems to solve, each of them will require separate one credit.
If resolving an issue requires changes in the Bacularis code, we can offer a patch file to apply to your existing Bacularis instance. Any such change will automatically become part of Bacularis and will be available to everyone.
Our response time on the support requests is maximum 2 business days. We do our best to respond as fast as possible nevertheless some complex support cases may require more time and should not exceed 2 business days. The support service is available from Monday to Friday from 9:00 to 17:00 Central European Time (CET).
We are responsible on solving Bacularis problems only. If during investigation we find that the source of the problem will be outside Bacularis such as in hardware layer, operating system layer or Bacula layer we may not be able to solve them. Despite of that in these cases we will be trying to help as much as we can but without guarantee of solving the problem.
If we are unable to resolve the Bacularis issue which the problem is in Bacularis code, we will refund you the money you spent to purchase the credit. We do not issue refunds for unresolved issues that originate outside of Bacularis.
If you would like to have a new function in the Bacularis that would be very useful for you, you can propose it and co-fund development for creating it.
New function co-funding works on the following rules:
Refund requests may be submitted within 14 days of the initial purchase.
For purchases processed by Paddle.com Market Limited or Paddle Payments Limited (depending on the Buyer’s location), acting as Merchant of Record, all refunds are handled by Paddle and are granted at Paddle’s sole discretion on a case-by-case basis. Paddle may refuse refund requests in cases of suspected fraud, refund abuse, or other manipulative behaviour.
For purchases made using other payment methods, refund requests are reviewed and handled manually.
This does not affect any rights that may apply under applicable consumer protection laws.
You can discontinue using our services at any time and without providing any reason. If before terminating on your User Panel account are the paid services, they will not be refunded. To permanent closing the User Panel and all repositories access, you can use a button that will delete the account. All your account and repository data will be removed.
We may terminate your access to our services at any time, with or without cause or notice, effective immediately, specially including cases if you violated these Terms of Service.
